Michel Dumont

In 1992, Michel was wrongly convicted of rape and sentenced to 52 months in prison. The primary cause of the wrongful conviction was faulty eyewitness identification by the victim. Unbeknownst to Michel, the victim had recanted her identification six months after his conviction. The victim saw the actual preparator while she was in a video store and realized her mistake. Michel was out on bail for two years pending an appeal. The prosecution did not notify Michel’s lawyer that the victim had recanted. Michel was severely beaten and sexually abused while in prison; he was released in 1997 after three years of incarceration. In 2001 Michel’s conviction was overturned by the Quebec Court of Appeal. The primary causes of Michel’s wrongful conviction are prosecutorial misconduct, police tunnel vision and eyewitness misidentification. Michel was unsuccessful in his attempt to receive compensation and in 2010 the matter was considered by the United Nations Human Rights Committee. Michel’s wife Solange Tremblay, whom he met just before his conviction, was essential in helping Michel navigate the system and fight his wrongful conviction. In 2002, Innocence Canada at a conference presented Solange Tremblay with an award recognizing her work in defense of her husband's interests.

Michel a été condamné à tort pour un viol de novembre 1990 en 1992 sur la base d'une identification erronée par un témoin oculaire par la victime. Il a été condamné à 52 mois. À l'insu de Michel, la victime s'était rétractée six mois après sa condamnation (mars 1992). La victime a vu le préparateur réel alors qu'elle était dans un magasin de vidéo et a réalisé son erreur. Michel a été libéré sous caution pendant deux ans dans l'attente d'un appel. Le parquet n'a pas prévenu l'avocat de Michel qui préparait son recours à l'époque. Michel a été sévèrement battu et agressé sexuellement en prison. Michel est sorti de prison en 1997 après trois ans d'incarcération. Sa condamnation a été annulée en 2001 par la Cour d'appel du Québec. Les principales causes de la condamnation injustifiée de Michel sont l'inconduite du procureur, la vision tunnel de la police et l'identification erronée des témoins oculaires. Michel n'a pas réussi à obtenir une indemnisation, ce qui a amené le problème jusqu'au Comité des droits de l'homme des Nations Unies en 2010. Son épouse Solange Tremblay, qu'il a rencontrée juste avant sa condamnation, a été essentielle pour aider Michel à naviguer dans le système et à combattre sa condamnation injustifiée. Innocence Canada, lors d'une conférence en 2002, a remis à Solange Tremblay un prix reconnaissant son travail de défense des intérêts de son mari.
